Gap Wedge Give Away

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THIS GIVE AWAY. THIS GIVE AWAY IS INTENDED FOR PLAY IN THE UNITED STATES ONLY (EXCLUDING PUERTO RICO) AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS GIVE AWAY IF YOU ARE NOT LOCATED IN THE UNITED STATES. THE GIVE AWAY BEGINS AT NOON (EASTERN STANDARD TIME) ON NOVEMBER 23, 2009 AND ENDS AT NOON (EASTERN STANDARD TIME) ON DECEMBER 20, 2009 (“PROMOTION PERIOD”). YOU MUST BE 18 YEARS OLD OR OLDER TO PARTICIPATE. VOID WHERE PROHIBITED.


By entering the Gap Wedge Give Away ("Give Away"), each entrant agrees to abide by these Official Rules.

SPONSOR: The Give Away is offered, operated and administered by Boxgroove.com (“Sponsor”), 65 East Gay St., Columbus, OH 43215.

HOW TO ENTER: During the Promotion Period, visit www.boxgroove.com/index/raffle/ and complete the Official Entry Form, as indicated. Limit of one (1) entry per person.

Participants must provide first and last name and a valid email address. Upon completion of the form, click the “submit” button to send the entry. Entries must be received by Noon (Eastern Standard Time) on December 20, 2009. All entries are subject to Sponsor’s Privacy Policy at www.boxgroove.com/index/legal/. Use of multiple email addresses will void entry. More than one (1) entry per person will void all entries for said household. No automatic, programmed, robotic or similar means of entry are permitted and individuals engaging in such practices will be disqualified. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in these Official Rules. All entries become the sole property of Sponsor and will not be acknowledged or returned.

ELIGIBILITY: The Give Away is open only to legal residents of the 50 United States (excluding Puerto Rico) and District of Columbia who are 18 years of age or older at time of entry. Proof of age and residency may be required. Employees of Sponsor and its subsidiaries, affiliates, parent company, retail locations, suppliers, distributors, advertising, promotion or any other agencies or entities involved with this Give Away and members of their families (parents, siblings, children, and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win. Void outside the United States and where prohibited. Give Away also void where restricted in a manner not satisfied by the publication of these terms and conditions on this website. No purchase necessary nor shall a purchase increase odds of winning.

DRAWING: Four (4) winners will be selected throughout the contest period of November 23 through December 20, 2009. Four random drawings (one per week) will be performed from all eligible entries received. The drawings will be conducted by Sponsor, whose decisions will be final and binding in all respects. Actual odds of winning depend upon the total number of eligible entries received as of the date of the drawing. The estimated odds of winning are 1:500, but will be subject to the final number of entries.

PRIZE: Upon certification by Sponsor as an eligible participant, each winner will receive one (1) X-Series JAWS Wedges with a total approximate retail value of $120.00 (the "Prize"). No substitution of the Prize or transfer of the Prize to a third party is permitted, except by Sponsor, who may substitute a prize of equal or greater value.

Taxes and duties (where applicable) are the sole responsibility of the winner. All expenses not specified herein, including, but not limited to local, state, or federal taxes on the Prize, are the sole responsibility of the winner. Entry in this Give Away constitutes each entrant's agreement to pay all applicable taxes and comply with all laws.

NOTIFICATION AND COLLECTION OF PRIZE: Each potential winner will be notified by email within two (2) business days of the drawing. Each potential winner is subject to verification and must meet all eligibility requirements before the Prize will be awarded. In the event that the potential winner does not meet all eligibility requirements, that person may be disqualified and the Prize will be awarded to another randomly selected individual. Each potential winner must follow the directions contained in the Prize Acceptance Form provided by Sponsor and email or fax all completed forms, correctly filled out and signed, and provide any additional information that may be required, to Sponsor within three (3) days of notification as a potential winner, including, but not limited to, an Affidavit of Eligibility/Further Release of Liability and Publicity Rights (where legal). Failure to respond within the time specified or other non-compliance with these Official Rules will result in disqualification as a potential prizewinner and void further participation in the Give Away. If a selected entrant cannot be contacted in a timely fashion, or if for any reason a Prize cannot be awarded, another Give Away entry will be randomly selected until the Prize has been awarded. Sponsor is not responsible for any failure for any reason whatsoever of the selected entrant to receive notification or for Sponsor to receive a selected entrant’s response.

WINNERS’ LIST: The names of the Give Away winners will be available after December 30, 2009 online at www.boxgroove.com/index/gwwinners/.

GENERAL TERMS AND CONDITIONS: To the fullest extent allowed by law, by accepting the Prize, the winner consents to the use of his/her name, city and state and/or likeness for purposes of advertising or trade without additional compensation. By entering the Give Away, all entrants consent to Sponsor’s collection, use and disclosure of personal information to any third party for the purposes of administering the Give Away and, unless otherwise specified, for consumer research and marketing purposes. To the extent permitted by law, upon entering into this Give Away, each entrant agrees to Sponsor’s use of his/her personal information, as described in its Privacy Policy and its Legal Statement located at www.boxgroove.com/index/legal/.

By accepting the Prize, the winner releases Sponsor, its subsidiaries, affiliates, parent company, its advertising, judging and promotion agencies, and the respective shareholders, directors, officers, distributors, employees and agencies of all such entities, from all liability arising from or in connection with the acceptance, possession, or use/misuse of the Prize. The winner acknowledges that neither Sponsor nor its agents have made or are in any manner responsible or liable for any representation, guarantee or warranty, expressed or implied, in fact or in law, relative to any Prize awarded herein, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose.

Sponsor assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transmissions or faulty network connections, whether human or technical in nature. Sponsor is not responsible for late, incorrect, lost, illegible, incomplete, stolen, damaged, misdirected entries or Prize claims. If, in Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Give Away, or if technical difficulties compromise any portion of the Give Away or the integrity of the promotion, Sponsor reserves the right to suspend, modify or terminate the Give Away and conduct drawings to award the Prizes using all legitimate and eligible entries received as of the date of action taken by Sponsor.

This Give Away is governed by the laws of the State of Ohio for the resolution of all claims and disputes.
